Professionals who are Canadian or Mexican citizens can file an application allowing them to find work in America. There is no limited number of renewals and the US doesn’t limit the number of TN visas handed out every year. The visa, authorized by NAFTA, is only for Canadians or citizens of Mexico. Immigrants already living in the US are ineligible. Canadian citizens can apply for the visa where they enter the country. Mexican citizens must visit a US Consulate to file the application.
1. Sponsoring Employer. To apply, a person must have a confirmed job offer from an employer who has stated a willingness to file the application for you.
2. Approved TN Profession. The occupation must fall into one of the professional categories covered by NAFTA. A complete list can be seen on the Canadian and Mexican Embassy websites.
3. Meet Requirements. You must meet the burden of proof that you qualify educationally for the job. For many TN occupations, this requires that you have a BA, or its equivalent, in the field. Depending on the job classification, you may be able to substitute five years of documented job experience.
4. Support Letter. Your employer should write a letter supporting your application and the letter should detail 3 things:
A. The letter should thoroughly describe the business. How many employees, basic financial statement, number of years in business and any relative information should be included. A letter demonstrating the employer’s need for you to fill the position will help tremendously in the application process.
B. Job Description. A detailed job description describing your duties should be included. The job description is also the place for the employer to explain why filling this position is crucial to the future of the enterprise. Unlike other visas, a TN visa applicant will not be questioned by an immigration officer, so the letter should pack in as much pertinent information as possible.
C. Employee’s Qualifications. Your employer’s letter should explain precisely how you are qualified for this specific position.
5. Gather Documents. Make sure you gather all of the documents required, including the employer support letter. These include:
- Valid passport
- Copy of your educational degree and transcripts
- Copy of your professional licenses
- Employment verification letters
- Resume
Canadian Procedures. Canadian citizens are not required to have a TN visa stamped passport and can apply at the port of entry. A Canadian must bring the application packet with them and explain to the Border Protection Officer at the Port of Entry that you are applying for TN status. The officer will review your paperwork and documentation and render a decision concerning admitting you to the country. You may be asked to go through a “secondary inspection” where a different officer will also review the paperwork and application. There will be a fee to pay. As of this writing, there is a $50 visa fee and a cost of $6 for the I94 card.
Mexican Procedures. Mexican citizens must have a TN visa to enter the US. Agencies recommend that Mexican citizens apply in Mexico as the officers in the consulates are more aware of the TN regulations and policies. An appointment with the consulate can be made by completing Form DS-160 online. The application fee of $190 and be paid online as well.
